Money is Precious Indeed, but Life is Invaluable ——The legal Prescription of the Case of Li-Yao
Zhaohui-Chen (School of law, Zhejiang Wanli College, Ningbo 315100) Abstract: The right of life and property are both the rights and interests that should be protected by the law. When the two are conflicting from each other, we should distinguish two kinds of situations: in civil society, right of life should be protected first; in national politics, choice should be made by considering the value instead of the ownership. The justice pursued by law is not a meaningless sacrifice. When be forced and cannot help but make a concession temporarily, it can’t be regarded as disobeying justice. “Life-and-death struggle” might not be the action of revolutionary heroism, but the external manifestation of the feudal harmful influence. Seeing one is committing a crime without grappling to stop it, should be denied by law naturally. But when the law performs its right role, the right of necessity should be respected at the same time. Key words: right of life; property; civil society; national politics; justice; concession
